Export Control

The University of Kansas enforces export control policies aligned with NSPM-33 to protect sensitive technologies and data from unauthorized access or transfer. These policies apply to all individuals involved in federally funded research and require compliance with EAR, ITAR, and OFAC regulations. Training, oversight, and proposal reviews are provided to ensure adherence and mitigate risks of foreign influence.

Summary

In support of National Security Presidential Memorandum-33 (NSPM-33) on strengthening and standardizing disclosure requirements for federally funded research, this Export Control Section establishes the institutional commitments, obligations, and procedures necessary to safeguard controlled technologies and technical data from unauthorized access or transfer. 

This policy applies to all University of Kansas faculty, staff, students, visitors, collaborators, and contractors (“Covered Individuals”) engaged in university research activities under federal awards. It encompasses the Export Administration Regulations (EAR), International Traffic in Arms Regulations (ITAR), and sanctions administered by the Office of Foreign Assets Control (OFAC), as well as any other export control statutes and executive orders. Covered Individuals must understand and adhere to these requirements when shipping materials, sharing data, presenting at conferences, accepting foreign nationals onto projects, or engaging in collaborations abroad.

The University of Kansas will provide required training, tools, and guidance to ensure compliance with export control laws. All federally funded research proposals and agreements must be reviewed by the Office of Global Risk & Security prior to execution. Noncompliance may result in administrative actions, funding penalties, and civil or criminal liabilities. By implementing this policy, the university fulfills NSPM-33’s mandate to protect U.S.-funded research from undue foreign influence while promoting responsible innovation.
